1. Purpose
This policy establishes the requirements governing commercial use of the Treasure Coast Photography Center (TCPC) studio. Its purpose is to protect TCPC, its members, and other studio participants by ensuring that individuals conducting commercial photography activities maintain appropriate liability insurance and comply with established studio rental requirements.
2. Definition of Commercial Use
For purposes of this policy, commercial use means any photography session, video production, workshop, or other activity conducted in the TCPC studio for which the member, photographer, instructor, organizer, or other individual or business receives, or expects to receive, monetary compensation.
Commercial use includes, but is not limited to:
Commercial use is determined by the nature of the activity and not by whether the individual conducting it is a TCPC member.
3. Mandatory Studio Rental
Any member or other authorized individual using the TCPC studio for commercial purposes must rent the studio at the applicable rental rate established by TCPC.
TCPC membership does not include complimentary commercial studio privileges.
All commercial activities must be scheduled and approved in accordance with TCPC’s established studio rental procedures.
4. Liability Insurance Requirements
As a condition of commercial studio rental, the individual or business renting the studio (“Renter”) shall, at the Renter’s sole expense, procure and maintain Commercial General Liability (CGL) insurance covering the Renter’s commercial activities and operations conducted at the TCPC studio.
Such insurance shall:
5. Proof of Insurance and Additional Insured Status
Before any commercial studio rental or photography session may begin, the Renter must submit to TCPC:
The Certificate of Insurance shall identify TCPC as the certificate holder and shall reflect the required Additional Insured status.
Listing TCPC solely as a certificate holder does not satisfy the Additional Insured requirement. A certificate of insurance alone does not create or expand insurance coverage.
All documentation must be received, reviewed, and accepted by an authorized TCPC representative before the Renter is permitted to begin any commercial activity.
6. Failure to Provide Required Insurance
No individual or business shall be permitted to conduct a commercial activity in the TCPC studio without satisfying the rental and insurance requirements of this policy.
Failure to provide acceptable proof of insurance and Additional Insured status before the scheduled rental shall result in denial, postponement, or cancellation of the commercial studio session.
No verbal assurance of insurance coverage shall substitute for the required documentation.
7. Responsibility and Liability
The Renter shall be responsible for conducting commercial activities safely and for complying with TCPC studio rules, applicable laws, and the terms of the studio rental agreement.
To the fullest extent permitted by applicable Florida law, the Renter shall indemnify, defend, and hold harmless Treasure Coast Photography Center, Inc., its directors, officers, employees, and volunteers from third-party claims, damages, liabilities, losses, and reasonable legal expenses to the extent arising from the Renter’s negligent acts or omissions, willful misconduct, or breach of the rental agreement, except to the extent caused by the negligence or willful misconduct of TCPC or other indemnified parties.
The obligation to maintain insurance does not relieve the Renter of responsibilities imposed by the rental agreement or applicable law.
8. Noncommercial Member Use
Studio activities conducted by TCPC members strictly for personal, educational, recreational, or other noncommercial purposes, without compensation, are not subject to the commercial rental and insurance requirements of this policy.
Such activities remain subject to all other applicable TCPC membership rules, studio-use policies, supervision requirements, and safety procedures.
9. Administration and Enforcement
TCPC reserves the right to deny or discontinue commercial studio use when the Renter fails to meet the requirements of this policy.
No exception or waiver of the insurance requirements shall be effective unless authorized in writing by the TCPC Board of Directors.
